December Remediation and Retroactive Pay Update for Unit 2 Members

Despite numerous attempts since September to get clear information from the York Administration, including the Faculty Relations Office, on the process and criteria for determining remediation pay for our members, we have yet to receive any clear guidelines or instructions.

Just this week, we received information that York’s payroll department has decided that the last remediation payments will be made on the January 25, 2019, payroll date. This is troubling, given that the deadline for students with deferred standing to complete outstanding coursework is Dec. 21, 2018. Thus many of our members will likely still be doing remediation work in January. We have contacted Faculty Relations about this matter.

We have already filed a series of cases with Ely Gelodof, the disputes arbitrator tasked with the review of the practical implementation of the Unit 2 Memorandum of Settlement, ratified on June 15, 2018.

In order to for us to ensure that you are paid what you are owed for your work to finish the teaching of your 2017-18 courses, please carefully review the seven scenarios below, and select the one that best applies to your situation. Then follow the instructions for the scenario that you have selected. In all cases, you will have the opportunity in the Pay Discrepancy Survey to provide details of your particular situation.

The information you provide will greatly help us prepare a second round of cases to submit to the Unit 2 disputes arbitrator for review.

Scenarios

1) I did not receive 65% of my outstanding pay on July 9, 2018.

Please fill out and submit the Pay Discrepancy Survey. In the “Type of Discrepancy” section, check the “July 9, 2018 65% Pay (Wages)” box. Please also include any other relevant information in the “Description” box.

2) I did not receive my retroactive pay on the October 25th, 2018, pay date.

On Oct. 25, 2018, you should have received retroactive pay of 2.1% on the total of your contracts from Sept. 2017 to Aug. 2018. This retroactive pay should have been listed as two separate lines entitled “Retro-Reg Earnings CUPE 3903-2” and “Retro Vacation CUPE 3903 Unit 2” on your paystub.

If you did not receive this retroactive pay, or dispute the amount, please fill out and submit the Pay Discrepancy Survey. In the “Type of Discrepancy” section, check the “October 25, 2018 Retroactive Pay (Wages)” box. Please also include any other relevant information in the “Description” box.

 

3) I have not yet submitted my Remediation Work Form.

If you did work to deliver and finish your 2017-18 courses after June 15, 2018, including in the August 2018 remediation period and beyond, you need to submit a Remediation Work Form for each of your courses as soon as possible. Your completed Work Form or Forms give you the opportunity to be paid up to 35% of your outstanding pay.

If you have any students who were granted deferred standing, which gives them until Dec. 21, 2018, to complete last year’s coursework, there are two options. In both cases, you will need to submit a Remediation Work Form:

3a) Our best advice is that you include on the Work Form an estimate of the time you expect that the grading and final grade preparation for these students will take.

3b) The second option is to continue to keep track of the hours that you spend on your course(s) to finish them, and then submit a Work Form.

Once completed for each of your courses, email the form(s) to the Chair of your Department or Hiring Unit, copying the Dean of your Faculty. A list of Faculty Deans, including their email addresses, is available at the bottom of this post. 

4) I have already submitted a Remediation Work Form, but I have not yet been paid my remediation pay.

Please fill out and submit the Pay Discrepancy Survey. In the “Type of Discrepancy” section, check the “Remediation Pay (Wages)” box. Please also include any other relevant information in the “Description” box.

5) I have submitted my Remediation Work Form, and have received remediation pay on either my September, October, or November pay. However, I dispute the amount that I was paid.

Please fill out and submit the Pay Discrepancy Survey. In the “Type of Discrepancy” section, check the “Remediation Pay (Wages)” box. Please also include any other relevant information in the “Description” box.

On your fall 2018 pay stubs, there are two separate lines for remediation pay:

“Remediation CUPE 3903-2” and “Vac. CUPE 3903-2 Remediation”

6) I submitted a Remediation Plan for my course(s), but the plan was not approved.

If you did any work on your courses, including delivering them in the August 2018 remediation period, please fill out a Remediation Work Form for each course. Please follow the instructions are outlined in 3) above.

7) I worked as a Unit 2 TA, but was not provided a Remediation Work Form by my Course Director (either CUPE 3903 or YUFA), even though I performed work.

If you did any Unit 2 TA work on your course, including work in the August 2018 remediation period, please fill out a Remediation Work Form for each course. Please follow the instructions are outlined in 3) above.

If none of the seven scenarios above apply to your specific situation, please fill out and submit the Pay Discrepancy Survey. Select the boxes that you think best apply, and include a description of your situation in the “Description” box.
